We are looking for a one-pager visual that provides our industry stakeholders with an overview of how the consultations are included through the regulatory process. The document should be provided in a format that can be posted on the Web and allows for modification.

Target audience: Canadians and industry stakeholders with a minimal knowledge of the regulatory process and the consultation process that is embedded within the regulatory process. We want this target audience to understand, at a high level, how regulatory initiatives are identified and prioritized, and when there are opportunities for participating to consultations through the regulatory process so their voice can be heard and taken into account through the development of the Canadian Aviation Regulations and associated standards. ** 1st paragraph = 1 box) 1. How Civil Aviation’s regulatory initiatives are identified and prioritized (high-level overview) We are looking for a one-pager visual that provides our industry stakeholders with a clear understanding of how the planned regulatory initiatives related to civil aviation are identified, selected and prioritized. For the purpose of this one-pager visual, the process should start with the identification of potential regulatory initiatives and should end with the publication of the Forward Regulatory Plan. The document should be provided in a format that can be posted on the Web and that can be modified. The Civil Aviation Program process for the identification and prioritization of regulatory initiatives is as follow: 1. The Canadian Aviation Regulations and standards are examined and analyzed at different stages of their lifecycle, namely (1) through the development of regulations, (2) through the regulatory management (while regulations are in effect), and (3) through reviews (such as the review from the Standing Joint Committee for the Scrutiny of Regulations (SJCSR)). 2. Issues are identified (e.g. missing regulation or a regulation that needs to be refined). For these issues, a policy approach is proposed (instrument choice) to resolve the issue identified. Early consultations are conducted (e.g. Policy paper or Preliminary Issue & Consultation Assessment (PICA)) to validate the proposed approach. 3. Regulatory development starts through the development of a regulatory proposal that builds on the policy work that has been completed. Additional early consultations are conducted to help refine the regulatory proposal (e.g. through a Notice of Proposed Amendment (NPA)). Several analysis are also conducted to support the proposal (Regulatory Impact Analysis, assessment of potential effects on the environment, Gender-based analysis plus (GBA+), one-for-one rule, regulatory cooperation/alignment) 4. Regulatory proposals are approved by the Treasury Board Secretariat (Triage document) 5. TC’s Departmental Regulatory Affairs work with the Civil Aviation Program to identify which regulatory initiatives are to be included in the departmental Forward Regulatory Plan (FRP). Prioritization of initiative is based on: o The risk level associated with the fact of regulating or not regulating on the issue. o Drivers such as Transportation Safety Board recommendations are taken into account. o Readiness level of the regulatory file (it is advanced enough to proceed with CGI or CGII during the timeframe covered by the FRP) o The internal capacity of TC to advance the regulatory files within the FRP timeframe. • TC’s FRP is approved by the Minister of Transport and published on TC’s website. This is the way stakeholders are informed of upcoming regulatory changes over a period of 24 months. • TC’s FRP is updated on a yearly basis. Calendar reference : This is an annual process. Each year by April 1, departments must: • develop a 24-month FRP that spans two fiscal years, starting from April 1 • include a link in their FRP to their regulatory stock review plan • post their FRP online and include a link to the FRP on their web page on acts and regulations ** second paragraph = 1 box
