to arslan: I guess you were following this contest, and to you, it might seem that way. to be honest, I was so sold on the font and color scheme that something else by mike other than the soundwaves could have won as well.

it's no problem Shewa. I respect that you want to protect your work and time investment. I understand your comments and I would get frustrated if I were in the same position as you. as Ataide said, part of this is due to the way 99designs is designed. after looking through many contests, it is designed in favor of the contest holder getting what they want.
OK, I m sorry for all this confusion and copyright issue's. Mike accept my apologies if I insulted you or offended you in some way. Ch the decision is all up to you and I'll respect that, so sorry if for all confusion I started.
to Ataide: you're right. the way this is designed is not only as a competition but a collaboration. that's where boundaries can be crossed and create problems for the designers.
to Shewa: no that's incorrect. if someone else did that (a new designer), they would have no part in the originality of the final design. if someone did that, based on my directions, so could you and Mike. there would then be three identical designs, and we would decide who contributed the most to final/best design and who submitted it first. according to you, you submitted the idea and concept first and tailored it based on our feedback. so when Mike supposedly copied you, I said you could use his colors and font if me and my colleague decided that HE copied you first. we then decided that his concept is original because of his use of the color scheme, font, and different design of the soundwaves. the only thing he changed was the placement of the soundwave. he had the soundwave surrounding the musical note from the beginning (with the same shape/font). also, so many of these designs are so simplistic, that there will always be a fine line between who has the rights to which aspect of the design. that is a problem, in part, because we asked for a simple design and gave constant feedback on what we wanted.

So if you say I like Mike's font, Shewa idea of soundwaves, colors of x design, should new designer trace Mike's font, trace mine soundwaves, and apply colors of x design to make something you will choose as a winner?
A bunch of designs got 5 stars, so I wouldn't worry about that part. I use the stars to guide people in the right direction, rather than it being the final judgement. I understand that my suggestions led Mike to a design that was more similar to yours than you would want. My suggestions to you also led you to a design that was different from your original (i.e. with the EQ/volume bars and headphones). Others might have complained if I chose your original design with headphones, because they could have said that you copied their color scheme or their use of the bars above the logo. It's hard to say who is the original one, because there can be arguments about who used which color first, which soundwave first, or which font first. UItimately, I'm looking for the best possible design which is a combination of many different aspects of designs that have been submitted throughout the contest. My feedback is what leads to the final design. I made a judgement call, and I think Mike's submission is fair. I hope all this makes sense.
Yes but you say to me "i like the soundwaves coming out of the D in sound. can you try that logo without the bars and headphones above the hyped sound?" and i did what you ask and got five stars. To him you said "my colleague likes the design, but I'm not sold in having a music note in our logo and I like the font, so maybe some other social networking/music type logo or vibe would work better" and then he based on my previous submission rated with 5 stars put his two sound waves over h and got the design with 5 stars also. Then you ask him to make even more similar design to mine with comment "you could add a third soundwave inflection that would probably give it more of a music feel". So you were leading him to make design more like mine? Anyway, I m withdrawing my entry's with my original idea and maybe I will try something else(just hoping no one will copy that design). I agree with Mike's comment. What led us in the direction of the current designs was Shewa's #135 that had the soundwaves. But Shewa was also incorporating the color schemes and EQ/volume bars of other submissions. All the ideas were a combination of ideas and feedback from us (CH) that would lead to the best design. After we went in the direction of the soundwaves, Mike incorporated the soundwave inflections he already used in previous designs surrounding his musical note, and made the idea his own by incorporating a whole new font, color scheme, and soundwave design of his own. The tagline was my colleague's idea, so that was set in stone for the designers. I hope that clears things up.
To shewa and everyone involved in this conversation, I am responding to defend my design. I feel the design is my own. My font is custom, by which I mean I drew with pen tool and my colors were the first to be used in this contest.
If you read Shewas comments on his design the CH referenced my work and recommended he try the colors I used in my design ... is that copying or part of the 99design.com process? How about the many designs with sound waves in them? Did we copy from them? Im sorry you feel the way you do, but with the open display of designs and comment/feedback of 99designs.com, promotes overall best design. My apologies for your frustration... this site can be frustrating period. If the CH sees a problem, I will withdraw my entries. I only am here to design the best overall concept.
Why thumbs down? Did I said something wrong? Did i say something isn't truth? Did I offend someone? This happens to me all the time and I hope some of you could understand my frustration. Currently I m participating two contest where people copied my design and also get five stars. When I submit design, and someone notify me of similarity with design already submitted I withdraw that entry, because i think this is the way things should be.

As can everybody see in my entry #94 i integrated sound waves and explain my concept (almost no one do this, they just submit with no explanation of the symbol or why did they make logo like that), and when Ch said that he loves the idea behind explanation but he doesn't like symbol so much, I continued to work on that idea and submit my other proposal #123. This is proof that my designs was first with Sound waves. Before that everybody was stuck with bars and letter H.
Ch, if you like my idea but not so much execution I could always work more until you are satisfied with design. All I need is feedback like- move the symbol around, or change the font, make color variation... Then we wont discuss about this problem because I will probably do the same thing like Mike and move my symbol to left above "h". Now we have mine original idea and copied design with little tweaks.
Providing feedback is very important but the bad thing about this is that everyone can see what CH wants to change in our designs and submit their variation with small changes. That is why I vote for personal feedback via private messages.
