    yea honestly i was quite surprised to not have gotten a response from anyone from 99designs, and just figured i couldn't really sit around and let my company and the people it will service be held up by the whole situation.

    other partners of mines who also run contests on here were shocked and a little confused by it as well

    Yeah, I've contacted 99designs a few times myself, and they've always gotten back to me. I'm going to see what they have to say about this themselves.

    If the site owner doesnt know what to do to protect its clients, I'd like to know it.

    that's odd that the 99 staff never got back to you..
    i've emailed them on several occasions with questions (or reporting other infringements)
    and they've always responded..
    sometimes it took a few days.. but i have to give them credit that i've always gotten a response.

    my guess is they didn't know just how to handle it and were hoping you resolved it, as you thankfully were able to..
    .. maybe this is the first time that this situation has ever happened on this site and they just didn't know WHAT to do?

    UPDATE:

    I have finally, as of this morning, secured the rights & ownership to the 'ganja bee' and any variations from the original creator, so the logo situation is taken care of. i will take just a few days to recoup the investment that i had to make into it, and i will be ready to award a winner in the stationery contest in a few days.

    this whole thing has kind of thrown the budget and scheduling off, but none-the-less we are marching forward! ;)

    so thank you all for your patience and support!

    JR & Dniner: I totally understand your frustration to the situation, and you are right in the statement that, who knows what would have happened if everything was already printed, but the fact is that I am so glad that this was caught and taken care of beforehand, because it may have not been as much of a forgiving situation.

    Also to JR, I actually had purchased Rickshow's design at the same time that I purchased prowler's. i agree that rick's was more polished and as an artist and illustrator myself, i really appreciate the artistry that went behind it, and had to purchase it lol! I had a hard time with this contest because of it, but i had to step away from my artistic side and listen to my market.

    i have a strategic way that i plan on using both, because they appeal to different audiences. but for now the biggest side of the audience likes the version that officially won, (although again, i bought both versions so there were technically 2 winners)

    Also, you are right that my time cannot be repaid, and because a lot of time was spent and wasted on this, and because the situation is resolved as far as my business, i don't have the time right now to go through all of the trouble of getting into a bunch of legal things. because i now own the logo, i would rather spend my time moving forward and building the company.

    what you guys and gals feel you have to do as far as this situation is your decision. i was only trying to provide a chance for redemption, but i understand that some will be satisfied and some will not.

    before i spoke with prowler and got his cooperation, i had tried contacting 99designs numerous times, and unfortunately to this day have still heard nothing from them. so at that point i figured trying to get help from them was going to hold up the progress of the company because there was no response. that is the reason why i decided to go about it this way, because i have other designers in the other contest who have been waiting patiently for me to award a winner.

    but if you feel you would like to pursue this, i understand, but at the same time i hope that prowler can earn the trust back from everyone.

    once again, i thank you all for your support and help with this, and i look forward to having clean future contests and hope that all of you great designers will participate in them:)

    First of all, I would like to know how Prowler Concepts came up with his business name. It is disturbing that he may have set up to do what he'd doing.

    Secondly, what is this? The Dr. Phil show? You do the crime, you do the time.

    If you steal at work are you going to get your hands slapped if you admit it and apologise? No. You'll get fired, because the trust is broken. If a child steals a candy are you going to take them back to the store and have them return 'some of it"? No.

    Prowler Concepts got caught doing copyright infringement. Because its illegal, he's lucky he's not on his way to court over a major lawsuit, brought by on the designer and 99Designs.

    This situation sets a precident, and says its okay to to it, we'll still love you, you'll just have to pay the money back if you get caught and then you can keep on doing it, or maybe not.

    This devalues the work of 'real' designers and it devalues the fact that this is illegal.

    I would like to know 99Designs stand on this.

    All in favour of Prowler Concepts being barred from this website, please email 99Designs and let them know. Personally, I don't want to be associated with people like that. He's luicky this time, he cqn still continue on with graphic design, as the public isn't aware of this, but not at this forum, not at 99Designs.

    He screwed up, and if he just gets barred from 99Designs, I think he gets off easy.

    First of all, all this could be taken as a nice lesson even though this isnt a learning lessons website.
    Prowlerconcepts did the right thing and in the end, hopefully, everyone will be satisfied. I know I already am.

    AaronBeats acted as a real professional and he managed to give all this a nice closure (hopefully that ganja-bee designer isnt some dork who asked for some crazy amount for it). 99 designs definitely needs people like AaronBeats is and the fact that he is not going to run away, take some legal actions which isnt good for any of us here, or anything else from staying and having faith in working with us here is a good thing.

    Also, prowlerconcepts could easily open another account but he did better... He proved himself as a designer who can play fair. Even though he is probably a young person who is tempted to do crazy stuff like this one was, I want to congratulate him. He turned out to be a cool guy and I want to apologize for being harsh and reconnoitring.

    Bad publicity is something that none of us wants so watch your steps people. ;)

    but it would seem that once the issue came to light ..
    maybe Aaronbeats should have just reported him and gone with the second choice

    In my opinion, Rickshow's had a more polished and more memorable look,, and no legal mess. ; )

    why is prowler still allowed to be on this site..?

    so he apologized.. big whoope do..

    i'ts the old adage.. is he sorry.. or is he just sorry that he got caught..?

    This is a site to serve clients, not to "learn lessons".
    if he doesnt know it's illegal to copy a logo form someone, then he shouldn't be on this site. period.

    so theyr're working it out...

    What if he had not been caught til AFTER AaronBeats had printed stationery, brochures, tshirts, etc.
    would ArronBeats have been so forgving.. i doubt it.

    if he had copied a mayor company's logo and gotten sued.
    would just apologizing and giving back the mony been ok..? doubt it.

    seems to me that he already has cost the client a lot of TIME in trying to straighten his mistake...
    is he paying back Aaronbeat's time as well...?

    If any lawyer does something that every lawyer knows is wrong. theres a little something called disbarment..
    we can't take away his computer.. but i dont understand why he is allowed to be on this board... seems like he should have been automatically banned from this site...

    I have to appologize-- I didnt read through everything. Although I believe that he did know what copyrights are he did make a mistake and violate them. He is doing the right thing to fix that and we should not look back at what he did since he is making it right. It is going to take time for him to gain trust back but that is something he has to deal with

    First of all, I want to thank AaronBeats for helping me through the entire situation. I know it was a mess, and he handled it very well. I can tell he will be able to do great things with his company. I am truly very sorry to him, the designers for his new contest, the original artist, and to all graphic designers in general. What happened was unnecessary and inappropriate. I was very willing to help resolve the situation and help clear my name. As he said, I have definitely learned my lesson, and won’t forget it any time soon.

    UPDATE:
    Again thanks to everyone who is being supportive. To update the situation, prowlerconcepts has been in contact with me and been very apologetic and expressed that he is still a student to the design industry, and because if this didn't know that if he modified someone else's work that it was infringing on copyrights.

    He has stated that he has learned his lesson, and expressed his regret and seems sincere in his apologies. I only asked for a certain amount of money back because i am in negotiations with the original creator of the 'ganja bee' to buy the rights to it so that i may use it and the modified version created by prowler.

    Prowler is also assisting financially in the purchase of these rights from the creator, and had already refunded the amount of money that i requested with no trouble.

    Even though this has been a tough situation that is still being worked out and negotiated with the original creator, prowler has done the honorable thing, and has learned and states that he will from now on use only his creative abilities, which i still believe he possesses great creativity when applied properly.

    I have forgiven him and hope that he can redeem himself with all of you great designers as well as other companies and build his reputation back up to good standing.

    As far as things go, I'm still negotiating with the other creator, and should have everything worked out and hopefully settled in a few days, at which point if all goes well then i'll own the rights.

    To all other designers, be warned, this is something that you do not want to go through if you intend on having a long career in the graphic/design industry. It can hurt your career and haunt you for life. Even though I am being merciful and forgiving in this case, if you try something like this, you may not be that lucky!

    I can only be this way because I am about getting business done and making my company successful, and I believe that as long as I keep integrity and treat people good, situations and 'hiccups' that come will only be temporary, and i can focus better on what needs to be done to resolve the situation.

    So for those who want to become great successful designers, don't try this at home! lol!

    So again, i should own the logo and be ready to move forward again in a few days...and on that note, here is prowler with a sincere apology to redeem his name....

    Hey AaronBeats! I think prowlerconcepts should pay the original logo for you. He cheated and stole a design and make a fool a lot of designers from 2 contests, he should fix the mess that he created.
