I've always understood that the right to use a particular element/concept to develop a logo design is mostly compromised if the design is too similar to another design already in existance, and/or is being used by another who's in direct competition/same industry. So long as it is an original design, not too similar to another, and not in direct competition with another, there is no relevant concern.
So while it is highly unlikely that anyone can claim all rights entirely to using a shell or any other general image so long as design is unique and original; it is also relevantly not wise to use a design if anyone can prove that the design is too similar to theirs and compromises their established use in some way - such a compromise would most likely occur if they are in the same industry.
I do not claim to be giving legal advise here, this is merely my opinion and understanding of things.

OK, here is a question regarding copyright so I can understand. If you can not use a shell in a logo because of 'Shell Gas' does that mean the following are breaking the law?

I am sure we all are curious... There are many more out there. isnt it that you can not use the exact shape and color scheme? Perhaps this is a question for sitepoint?

My thought...unless in the "gas" or "oil" industry there is no real concern against using the shell/security design for a concept. Just like using any alphebet letter, such as the letter "A" dressed up and arranged in many different styles, no one really owns that letter, I'm sure that "Shell" cannot claim that they own the actual general image of a shell - just my thought and experience.
Please do be controversial on this thought, if proven so - for I am all ears.

Just a note here:
Since the existance of Shell Gas logo i think it is properly to inform you that
if you choose a shell logo symbol then your company identity might be compromised.
I know it's a bit utopic, but through their design skills they can aproach dangerously
to the edge of being acused of copying the company's above mentioned logo.
So, feel free to put your input here.
